Superpartners: Call back allowance survey

The FSU has received a number of enquiries from members who have been advised that payments and/or TOIL relating to Call Back allowance will only apply after a period of unpaid work has been completed – in effect staff have been advised that the first 59 minutes or the first 30 minutes of work will not be recognised by Superpartners therefore will not result in any payment or TOIL being applied.

Members were also advised that any TOIL accrued as a result of being recalled to work must be used within 4 weeks or it will be lost.

Your rights

The Superpartners Enterprise Agreement 2009 states:

Clause 5.10.4 - Call Back Allowance

  • Employees in job Grades 1 to 5 who are recalled to work after having completed their ordinary hours shall be paid in accordance with the rates prescribed in Clause 5.8 with a minimum payment of 4 hours.
  • Employees in Grades 1 to 5 who are recalled to work on a Weekend, Public Holiday or RDO shall be paid at the rate of double time, with a minimum payment of four hours.
  • Employees at the Grade 6 level and above who are recalled to work will not be eligible to receive a call back allowance. The additional hours worked by such employees will be dealt with in accordance with Clause 4.8, with the minimum period recognised for TOIL purposes being four hours.
  • For the purpose of assessing payment or TOIL, time spent on journey from home to work and from work to home by the most direct route shall be included.
  • The minimum payment or allocation of TOIL of four hour for an initial call back is inclusive of any time spent on subsequent call backs, i.e. four hours must have elapsed since the initial call back before any further call back allowance can be claimed.

 

What does this mean for you?

If you are a Superpartners employee and you are recalled to work - this also includes dialing in from home - after having completed your ordinary hours, you are entitled to receive a minimum of 4 hours pay (Employees Grade 1-5) or a minimum of 4 hours TOIL (Grades 6 and above).
