Thinking of working this Easter?
Tuesday, 16 March 2010
Bankwest has decided to open a number of branches on Easter Saturday. We have been contacted by members asking what are their rights in relation to being required to work on this day? Although Easter Saturday has been declared a trading day for businesses, the Bankwest 2007 Workplace Agreement (Clause 31) notes that for Bankwest employees, this remains a Public Holiday.
Can I be forced to Work?
No. Bankwest should ask employees in the branch network to volunteer to work this day. Your Manager should discuss with you if you are able to work and explain that the hours worked would be in addition to your normal hours and paid at overtime rates. Check below how this would affect you.
Branch Network Employees
- Employees who volunteer to work on Easter Saturday will be entitled to a payment of 100% loading ie: Double time.
- Employees who are contracted to work Saturdays as part of their “Ordinary Hours” have the right to decline working on the Easter Saturday. If they are contracted to work Saturdays and choose not to work Easter Saturday will be paid at their flat rate ie: no loading will apply for Saturday.
- If you are contracted to work Saturdays as part of your “Ordinary Hours” and decide to volunteer to work that day you will be paid a loading of 200%.
Non Standard Working Hours Departments
Employees who work in an area covered by Clause 24 of the Bankwest 2007 Workplace Agreement and are rostered to work on Easter Saturday will receive a 200% loading for hours worked on that day.
