Key features: Sick leave and personal leave - CBA Enterprise Agreement 2010 - Consultation

KEY FEATURES

Personal/Carers Leave (Sick Leave)

The new proposed enterprise agreement captures the sick leave provisions under the new National Employment Standards. CBA employees are entitled to10-days’ paid personal/carer’s leave safety net for each year of service. This leave will accrue progressively.

An employee will not be required to produce a medical certificate for absences of two consecutive working days or less.

This new proposal does not allow CBA to refer employees to an independent medical practitioner whilst using their accumulated sick leave. CBA, however, can request the employees to produce medical certificates where there is a pattern of frequent absences or there is doubt as to the genuineness of illness of injury.

This clause is subject to the new “binding recommendation” provision under the Dispute Settlement Procedure.

Additional Personal Leave

If you have exhausted your accrued sick leave, employees with 12 months service or more will have access to “unlimited” paid sick leave under the proposed Enterprise Agreement. To qualify for this entitlement employees must adhere to the following when required by CBA:

  • Provide evidence, including a medical certificate from a doctor as to the nature and genuineness of the illness or injury
  • Participate in an appropriate return to work programme
  • Be referred to an independent medical practitioner for examination


CBA has proposed to exempt this clause from the ‘binding recommendation” provision under the Dispute Settlement Procedure.
