CBA Shiftworker Provisions

As part of the negotiations for the 2020 EA, CBA are proposing changes to the way shiftwork is dealt with by your EA. In order to properly consider these changes we need to hear from you. We’ve put together a summary of the changes below, and we’re hosting a mass member meeting online on 25 August to discuss. RSVP here.

 

  • A 7-day shift worker is someone who is regularly rostered to work on Sat, Sun and public holidays.
  • A 5-day shift worker is someone who is regularly rostered to work from 6am to 11:23pm Monday to Saturday.
  • Usually if you’re a “shiftworker” for the purposes of the EA, you know about it. If you’re unsure, give us a call on 1300 366 378.
CBA are proposing changes to the definitions that dictate what loading a shift attracts. Those changes are outlined below.
  • Morning Shift:
    Current Definition – Commencing on or after 6am and before 8am: 12.5%.
    Proposed Definition – Commencing on or after 4am and before 7am: 12.5%
  • Afternoon Shift:
    Current Definition – (branch employees only) commencing on or after 4pm but before midnight and finishing after 9pm: 17.5%.
    Proposed Definition – (not limited to branches any more) Finishing at or after 8pm but before midnight: 17.5%
  • Night Shift:
    Current Definition – Commencing on or after midnight but before 6am: 25%.
    Proposed Definition – Commencing before 4am and finishing at or after midnight: 25%
This proposal changes the definitions of morning, afternoon and night shifts. It also has the effect of slightly modifying the loadings that would apply to certain shifts for some people. The impact of the proposed changes would differ depending on the division of the current EA that you work under and your roster patterns. We need your feedback on these proposed changes below. *The current definintions are slightly different for those working at Comminsure but the proposed definitions are what CBA are looking to implement across the board.   • There are two sets of preserved conditions for shiftworkers, those affecting workers who commenced their role prior to the commencement of the 2010 Enterprise Agreement and a separate group of preserved conditions for those who work in Direct Banking and Technology, Operations and Procurement.
  • CBA’s proposed changes would remove these legacy provisions and place all Shiftworkers onto the hours/loading structure detailed above.

For those with preserved conditions related to commencing their role prior to the 2010 Enterprise Agreement, the changes are outlined below:  

Afternoon Shift:

Current Definition – commencing after 10am and at or before 4pm: 17.5%
Proposed Definition – Finishing on or after 8pm but before midnight: 17.5%

Morning Shift:

Current Definition – Commencing at or after 6am and before 8am: 12.5%
Proposed Definition – Commencing on or after 4am and before 7am: 12.5%

Night Shift

Current Definition – Commencing after 4pm and before 6am: 25.0%
Proposed Definition – Commencing before 4am or finishing at or after midnight 25.0%

This change would change the effective definition of shifts, and therefore the loadings paid. For those working in Direct Banking and Technology, Operations and Procurement, the following changes are outlined below:  

Morning Shift:

Current Definition – Commencing at or after 6am and before 8am: 12.5%
Proposed Definition – Commencing on or after 4am and before 7am 12.5%

Afternoon Shift

Current Definition – Commencing after 10am and at or before 4pm: 17.5%
Proposed Definition – Finishing at or after 8pm but before midnight: 17.5%

Evening Shift:

Current Definition – Commencing after 4pm and before 6am: 25%
Proposed Definition – Commencing before 4am or finishing at or after midnight: 25%

This change would change the effective definition of shifts, and therefore the loadings paid. The impact of these proposed changes would differ depending your roster patterns. We need your feedback on these proposed changes below. We urgently need to talk to anyone whose shift definitions are governed by a preserved condition.
