Ekka Public Holiday - Know Your Rights!

Did you know that if you live in the SEQ metro area (Brisbane, Toowoomba, Sunshine Coast, Gold Coast), you are entitled to a paid day off on the Ekka public holiday if you normally work that day?

What this day is depends on which City Council area you work in. Click here to check for your Ekka public holiday date.

What happens if my employer needs me to work that day?

Your employer can request that you work on a public holiday, but only if that request is reasonable.

You have a right to refuse your employer’s request if the request is not reasonable, or if your refusal is reasonable (such as you cannot access childcare, for example).

This means that your employer is not allowed to roster you to work on a public holiday without asking you first and giving you a genuine opportunity to consider the request. Then, if you think your refusal is reasonable due to your personal circumstances, you can say no to working that day.

What if I’ve been told I have to work?
