RACSMS - EA Approved but not before threat of dismissal by the Fair Work Commission

The RAC Sales and Member Service Enterprise Agreement has been finally approved. It follows a dramatic turn of events where the FWC threatened to dismiss RAC’s approval application after a delay by RAC in submitting “undertakings” to address concerns raised by the FSU and the FWC.

RAC finally submitted the “undertakings” yesterday which moved the FWC to approve the agreement.

During bargaining the FSU had raised several concerns with RAC’s proposals that would result in workers being disadvantaged and/or worse off. RAC ignored these concerns. The FWC however asked RAC to remedy the shortfalls as part of the approval process.

You can read RAC’s “undertakings” here. This will form part of the enterprise agreement.

The agreement will come into effect from 16 November 2021.
