Can my employer force me to take annual leave over Christmas?

In the lead up to the end of the year, we wanted to remind you about your rights regarding taking annual leave over the Christmas and New Year period. 

Generally speaking, annual leave should be taken at a time that is mutually agreed between you and your employer, and your manager should first talk to you before requiring you to take any annual leave.

Any requirement by your employer for you to take annual leave must be reasonable and in accordance with either the Banking, Finance and Insurance Award or your enterprise agreement, if you’re covered by one.  

How much notice your employer is required to give you will also depend on the BFI Award or your enterprise agreement.  

Each enterprise agreement is different, and different rules may apply to your particular workplace. If in doubt, FSU members can log in and check your enterprise agreement on our website.
