MUFG’s misinformation – let’s correct the record

Since you voted ‘no’ to MUFG’s dismal proposed Enterprise Agreement, there has been a lot of misinformation flying around.

Here are two important facts you should be aware of (and if you want more information, we’re providing receipts!).

MUFG is required to provide at least the minimum pay rates and conditions in the Award (but they can provide pay and conditions above the Award at their discretion)
 

The Banking Finance Insurance Award and the Fair Work Act contain the minimum pay and conditions (BFI Award, clause 3.1). MUFG can pay you and provide conditions that are at or above the pay and conditions in the Award and the Act.

By bargaining, we are securing pay and conditions above the Award (Fair Work Act 2009 (Cth) sections186,193). In the meantime, MUFG can continue to pay you and provide conditions above the Award (BFI Award, clause 3.1). You might also have more beneficial pay and conditions in an individual contract.

Any threat by MUFG to reduce your pay and conditions to the Award rates is just that – a threat. If MUFG does this, it’s because they want to, not because they are legally required to, and trust us, they will have a fight on their hands if they try!

Securing work from home (WFH) rights in our Enterprise Agreement means we can all access the same minimum rights to consultation and a cap on forced days in the office.
 

The FSU’s WFH claim is to have a maximum 50% office attendance requirement. However, you will still be able to have an individual arrangement to come in less often (National Employment Standards, section 65). Likewise, you could come into the office more often if you wish to do so. Having these rights in our EA does not mean we all have to have the exact same arrangements!

The threat of attendance monitoring or formally managing non-compliance is not a legal requirement, it is simply a choice by MUFG. In many finance sector companies, workers have attendance limits in enterprise agreements where in-office attendance is managed through a consultative approach (such as at Cbus).

We are seeking a similar arrangement at MUFG – the ability to work with management to determine WFH arrangements that work for you and MUFG, just with a 50% cap on how much MUFG can force you to come in.

The FSU is committed to securing a fair Enterprise Agreement for everyone at MUFG as quickly as possible, and we believe in an accurate, transparent bargaining process.
