Can I be forced to use my long service leave?

The FSU is aware that some members have recently felt pressured by Westpac management to use their accrued long service leave (LSL) at times that do not suit them.

Here are the facts, according to our Westpac Group Enterprise Agreement 2025:

  • Westpac may only require you to take LSL on up to three occasions per accrued service period. These periods are after your first 15 years of service, then after every subsequent 10 years.
  • However, Westpac must give you at least six weeks’ notice.
  • Outside these occasions, Westpac cannot force you to take LSL whenever it suits them.

If management’s request to take your LSL is not consistent with the above points, then you do not have to agree to it. 

LSL is an important (and uniquely Australian) entitlement, which union members fought hard to achieve. It provides an opportunity for long-term employees to take a much-deserved break from work at a time that suits them.
