Aware Super intends to implement an office shutdown period from Tuesday 23 December to Monday 12 January 2026, which means employees will be required to use nine days of annual leave over this period.
We have written to Steve Hill, Aware Super Group Executive, People and Workplace, and informed him that this is not consistent with our Enterprise Agreement and must be immediately withdrawn.
While you can be directed to take leave over the Christmas and New Year period, Aware Super’s request is excessive and goes beyond what is usual for this period. Ultimately, this would require employees to use 45% of their annual leave.

We have now lodged a formal dispute with Aware Super about this, and are prepared to escalate this matter to the Fair Work Commission if we cannot resolve it directly with the Fund.
