NSW Bank Holiday – know your rights

The New South Wales Bank Holiday takes place on the first Monday in August each year. 

On Monday 5 August, bank branches and branches of non-banks in NSW (such as credit unions and building societies), must not open unless they are staffed by employees who have freely elected to work on Bank Holiday. 

This means unless you volunteer to work on Bank Holiday you can’t be required or directed to work and your branch must not open. 

But there are a few exceptions to when branches of credit unions and building societies are able to open on Bank Holiday: 

  • If employees have freely elected to work on Bank Holiday, or  
  • An enterprise agreement applies that says that employees receive a substituted day off in lieu of working Bank Holiday, or  
  • The branch of a credit union or building society has no more than five employees.
