Our AustralianSuper Agreement approved, Christmas/New Year leave

Our new AustralianSuper Enterprise Agreement has been approved by the Fair Work Commission.

This means the new and improved pay and working conditions we voted for earlier this year now apply. You can see a list of some of the improvements FSU members negotiated here.

FSU members made all the difference with getting our new pay and conditions over the line during this round of negotiations.

Our work doesn’t end here, though. To continue securing positive outcomes in the future – and to ensure our new Agreement is correctly implemented – we must keep our union strong. Ask your colleagues to join our union today.

Leave over Christmas/New Year period

Management at AustralianSuper went to great lengths during Agreement negotiations to make clear that the fund does not have a shutdown period between Christmas and New Year.

However, our new Agreement does allow your head of department to direct your team to take up to three days' leave over that period (29, 30 and 31 December 2026) if there are operational needs calling for it.

This direction cannot be dumped on you at the last minute - management must follow a process.

Here’s what you need to know:

  • You must be consulted first. No decisions can be made until your team has had a say and management has genuinely taken your views into account.
  • The minimum notice period to be directed to take leave is eight weeks. This means that any direction to take leave on 29, 30 and 31 December 2026 must have been given by now.
  • Additional paid leave gets used first - these are the five extra days of paid leave you receive each year under the Agreement, which don't accumulate from year to year. These days are used first during this period, but you cannot be directed to use more than three of them over the Christmas/New Year period.
  • If you are told verbally to take leave, you should ask for it in writing.

If you have been directed to take leave on 29, 30 and 31 December this year and the above steps have not been followed - or if you have any questions regarding the above information - please reach out to:
